Section 01
Scope & Overview
This Privacy Policy applies to The Real INS Group (“we,” “our,” “us”), an independent insurance agency licensed in multiple states. It describes how we collect, use, share, and protect nonpublic personal information (“NPI”) in connection with our insurance brokerage services.
This policy applies to information collected through our website (therealinsgroup.com), our online forms, phone interactions, email communications, and in-person meetings.
As an insurance agency, we are a “financial institution” subject to the Gramm-Leach-Bliley Act (GLBA), Title V, which imposes privacy obligations on how we handle your NPI. This policy serves as our GLBA privacy notice and satisfies our obligations to provide both an initial notice and, where required, an annual notice.
Not Legal Advice
This policy is provided for informational and compliance purposes. It does not constitute legal advice. If you have questions about your specific rights, consult a qualified attorney.
Section 02

We collect nonpublic personal information about you from the following sources:

We use cookies and similar tracking technologies to improve site functionality and analyze traffic. You may disable cookies through your browser settings; however, some features of our website may not function properly as a result.
Section 03
How We Use Your Information
We use nonpublic personal information to:
- Quote, bind, service, and renew insurance policies on your behalf
- Submit applications to insurance carriers and facilitate underwriting
- Process claims and assist you in the claims process
- Communicate with you about your coverage, renewals, and policy changes
- Respond to your inquiries, quote requests, and service requests
- Comply with applicable federal and state laws and insurance regulations
- Detect and prevent fraud, unauthorized activity, or illegal conduct
- Improve our services and website functionality
- Send you informational communications about products and services that may be of interest to you (with your consent where required)
We do not use your NPI for purposes unrelated to the provision of insurance products and services without your consent.
Section 05
Your Right to Opt Out
Under the Gramm-Leach-Bliley Act, you have the right to opt out of certain information sharing with nonaffiliated third parties. Because we do not share your NPI with nonaffiliated third parties for marketing purposes, the GLBA opt-out right has limited practical application to our practices. However, you retain the following rights:
Marketing Communications
You may opt out of receiving marketing-related communications from us at any time by:
- Emailing us at sales@therealinsgroup.com with “Opt Out” in the subject line
- Calling us at (317) 245-8700
- Replying STOP to any marketing text message we send you
- Clicking the unsubscribe link in any marketing email
Opting out of marketing communications does not affect our ability to send you transactional communications related to your insurance policies (e.g., renewal notices, policy documents, claims updates).
Processing Your Request
We will honor opt-out requests within 10 business days of receipt. For SMS opt-out requests, see Section 7 below for our specific TCPA compliance procedures.
Section 06
State Privacy Rights
Depending on your state of residence, you may have additional privacy rights beyond those described in this policy.
California Residents
California residents have rights under both the California Insurance Information and Privacy Protection Act (IIPPA) and, effective January 1, 2026, the California Consumer Privacy Act (CCPA) to the extent your information is not collected as part of an insurance transaction.
Under the CCPA, California residents have the right to:
- Know what personal information we collect, use, share, or sell
- Delete personal information we have collected (subject to certain exceptions)
- Correct inaccurate personal information
- Opt out of the sale or sharing of personal information (we do not sell or share for cross-context advertising)
- Limit our use and disclosure of sensitive personal information
- Non-discrimination for exercising these rights
To exercise your California privacy rights, contact us at sales@therealinsgroup.com with “California Privacy Request” in the subject line. We will respond within 45 days.
Other States
Many states have adopted the NAIC Model Privacy Regulation, which provides consumers with rights to access and correct their NPI held by insurance companies. If you believe we hold inaccurate NPI about you, contact us to request a review and correction.
| Right | How to Exercise | Response Time |
|---|---|---|
| Access your NPI | Email or call us | 30 days |
| Correct inaccurate NPI | Email or call us | 30 days |
| Opt out of marketing | Email, call, or reply STOP | 10 business days |
| Request deletion (CA) | Email with subject “CA Privacy Request” | 45 days |
| File a complaint | Contact your state insurance department | Varies by state |
Section 07
SMS & Text Message Communications
This section governs our use of SMS/text message communications and describes your rights under the Telephone Consumer Protection Act (TCPA), as amended, and applicable carrier guidelines.
Consent Required for Marketing Messages
We will not send you marketing or promotional text messages without your prior express written consent. Consent is obtained through an affirmative opt-in action (e.g., checking an unchecked box on a form) and is never inferred from silence, pre-checked boxes, or existing business relationships alone.
When you provide your phone number on any of our forms, the following consent language applies to SMS marketing communications:
Consent Language (where displayed on our forms)
“By checking this box, you agree to receive promotional text messages from The Real INS Group at the phone number provided. Message frequency varies (up to 8 messages per month). Message and data rates may apply. This is not a condition of purchasing insurance. Reply STOP to cancel. Reply HELP for assistance.”
No Sharing of Mobile Information
Mobile information and SMS/text-messaging consent are not shared with third parties or affiliates for marketing or promotional purposes. The Real INS Group uses your mobile number and SMS opt-in solely to send the text messages you requested; we do not sell, rent, or share your mobile information or messaging consent with any third party or affiliate for marketing.
Transactional Text Messages
We may send you transactional text messages — including appointment reminders, policy renewal notices, claims status updates, and responses to inquiries you initiate — without separate marketing consent, based on our existing business relationship. All transactional messages will identify The Real INS Group as the sender and include opt-out instructions.
Required Message Disclosures
All text messages from The Real INS Group will include:
- Identification of The Real INS Group as the sender
- Opt-out instructions: Reply STOP to unsubscribe
- Help instructions where applicable: Reply HELP for help
How to Opt Out of Text Messages
You may opt out of text messages at any time using any of the following methods:
- Reply STOP to any text message from us — all of the following keywords trigger immediate opt-out: STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, UNSUBSCRIBE
- Call us at (317) 245-8700
- Email us at sales@therealinsgroup.com
We will process opt-out requests within 10 business days. Upon opt-out, you may receive one confirmation text message that does not contain marketing content. We will not send marketing messages to numbers that have opted out.
Message Timing
We do not send promotional text messages before 8:00 AM or after 9:00 PM local time in the recipient’s time zone.
Record Keeping
We maintain records of all SMS consent, opt-in timestamps, IP addresses, and opt-out requests in accordance with TCPA and carrier requirements. Our text messaging programs are registered with The Campaign Registry (TCR) as required by major wireless carriers for A2P 10DLC messaging.
Cost and Carrier Charges
Message and data rates may apply based on your mobile carrier’s plan. The Real INS Group does not charge you for text messages, but your carrier’s standard messaging rates apply.
TCPA Compliance
Violations of the TCPA may result in statutory damages of $500–$1,500 per violation. We take our TCPA obligations seriously. If you believe you have received a text message from us in error or without proper consent, contact us immediately at sales@therealinsgroup.com.
Section 08
Electronic Communications & E-Sign Consent
By using our website, submitting a form, or engaging our services electronically, you acknowledge and agree to the following disclosures required by the Electronic Signatures in Global and National Commerce Act (E-SIGN Act).
Consent to Electronic Communications
When you submit a form on our website or communicate with us electronically, you consent to receive records, documents, notices, and disclosures electronically (“Electronic Records”). Electronic Records may include quotes, coverage summaries, policy documents, renewal notices, and other communications related to your insurance.
Right to Paper Copies
You have the right to request and receive a paper copy of any Electronic Record. To request a paper copy, contact us at sales@therealinsgroup.com or call (317) 245-8700. There is no fee for paper copies of insurance documents.
Withdrawing Electronic Consent
You may withdraw your consent to receive Electronic Records at any time by notifying us in writing at sales@therealinsgroup.com. After receiving your withdrawal, we will resume sending paper communications. Withdrawal of consent does not affect the validity of any Electronic Records already delivered.
Keeping Your Contact Information Current
You are responsible for ensuring we have your current email address and contact information. If your contact information changes, notify us promptly. If we are unable to deliver Electronic Records to your current address, we may revert to paper communications.
Hardware and Software Requirements
To access Electronic Records, you need a device capable of accessing the internet, a current web browser, and the ability to open PDF files (e.g., Adobe Acrobat Reader or equivalent). If you are unable to access Electronic Records in the format provided, contact us and we will provide an alternative.
Section 09
Data Security
We maintain an information security program that includes administrative, technical, and physical safeguards designed to protect your nonpublic personal information against unauthorized access, use, or disclosure. Our program is designed to comply with applicable state insurance data security laws, including the NAIC Insurance Data Security Model Law (adopted in 28+ jurisdictions).
Our Security Safeguards Include
- Access controls: Employee access to NPI is limited to those with a legitimate business need. Authentication and authorization controls are in place.
- Encryption: Sensitive data transmitted to and from our website is protected via TLS/SSL encryption. Stored NPI is protected with appropriate encryption where feasible.
- Third-party oversight: All service providers with access to NPI are required to maintain written data security and confidentiality agreements.
- Employee training: Personnel with access to NPI receive training on privacy obligations and data handling practices.
- Incident response: We maintain breach notification procedures and will notify affected individuals and regulators as required by law in the event of an unauthorized data incident.
- Secure destruction: NPI is securely destroyed or de-identified when no longer needed for business or legal purposes.
Data Breach Notification
In the event of an unauthorized access, acquisition, use, or disclosure of your NPI that creates a reasonable risk of harm, we will notify you and applicable regulatory authorities without unreasonable delay, as required by state insurance data security laws and state breach notification statutes.
Your Role in Security
While we take strong measures to protect your information, no security system is impenetrable. We encourage you to protect your own information by using strong passwords, not sharing login credentials, and notifying us promptly if you believe your personal information has been compromised.
Section 10
Data Retention
We retain your nonpublic personal information for the duration of our business relationship and for a period thereafter as required by applicable law, insurance regulations, and our legitimate business needs. Typical retention periods include:
- Insurance applications and policy documents: Minimum 5–7 years following policy termination (varies by state)
- Claims records: Minimum 5–10 years following claim closure (varies by state)
- Consumer inquiries and correspondence: Minimum 3–5 years
- SMS consent and opt-out records: Minimum 4 years following the last interaction
- Website form submissions: Minimum 2 years
Records are securely disposed of or de-identified at the end of the applicable retention period. We may retain records longer if required by law, pending litigation, or regulatory investigation.
Section 11
Children’s Privacy
Our website and services are not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us immediately and we will take steps to delete such information.
Section 12
Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, applicable law, or regulatory requirements. When we make material changes, we will update the “Last Updated” date at the top of this page. If we make changes that significantly affect how we handle your NPI, we will provide additional notice (e.g., via email or a notice on our website) where required by law.
Your continued use of our services following notice of changes constitutes your acknowledgment of the updated policy. We encourage you to review this policy periodically.
